The operation was out of ration at the start of the inspection, as there was only one staff present and there were a total of 10 children present with two of those children being 17 months and younger of age and the remaining eight children were between the ages of 18 months to 3 years of age. The requirement for the maximum number of children that one caregiver may supervise in a licensed home with two children being 17 months and younger is five children between the ages of 18 months to 3 years of age with only one caregiver. *Compliance was obtained when the second staff arrived to the operation.

There were only 17 hours avaiable for review for the primary caregiver for the last training year, 2021-2022, therefore, 13 hours were not able to be reviewed. For the other staff, there were only a total of 4 hours that were able to be reviewed during the inspection for annual training year 2021-2022.

An infant in care was not strapped in to the high chair as required. **This was corrected when the provider strapped the child in to the high chair.
The active play equipment in the back play area is not used per manufacturing instructions for the children that are permitted to play on it based on the ages of the children that can play on the equipment.
The use zone for a stationary equipment was observed and the use zone for swings on the stationary equipment did not meet the required use zone as it did not extend twice the height of the vertical distance from the swing beam to the surface below and only measured. Additionally, on the stationary equipment the slide attached did not meet the necessary use zone of 6 feet all around.
Based on the evidence obtained during the investigation, the operation increased the size of the outdoor play areas used by the children in care prior to notifying Child Care Regulation.
Based on the evidence obtained during the investigation, the operation has allowed children that are younger than five years of age to play in the front yard. The front yard is not fenced in and therefore, cannot be used for outdoor time by children that are younger than school age.
A caregiver was missing 5 clock hours of the required 24 clock hours for annual training from 6/28/2021 - 6/28/2022.
A child with a listed diagnosed food allergy did not have a food allergy plan in file for review.

The operational policies did not have a complete policy regarding information to parents about the promotion of physical activity.
Two children's files were missing information in their file. One child was missing the home address/parent home address and missing the address for one emergency contact listed by the parent. The other child file was missing the safe sleep policy in file by the parent and signed by the parent, as well as was missing the parent signature at the end of the child admission record form.
The fence had a hole and an adult hand could easily fit through the hole and it posed a hazard and risk for a child as the play area was not properly enclosed.
A gate of the fenced area was not properly enclosed as the fence picket had split and the bottom hinge of the door was not properly installed. The gate is a risk to children as it could splinter children, or cause a body part to become smashed or injured and if not fixed could potentially fall on a child when opened incorrectly as only one hinge is properly attached.
Children were observed eating snack without washing their hands.
A climbing structure and a Little Tyke slide were observed being used by children and each structure did not have their own use zone of six feet and overlapped with one another.
There was no policy in the operational policies regarding the animals in the home.
The additional caregiver in the home did not have proof of having obtained orientation of any of the required topics or receiving the operation policies and did not have a copy of the photo ID in file as well as did not show the hire date.
A cat was observed in the home during the inspection and the operation did not have pet vaccinations or pet health statement in file for review when requested.
The additional caregiver employed did not have CPR or first aid training in file for review.
The children were observed playing outside and there was a broken gate with a screw sticking out and this broken gate could also be a pinching hazard. The additional back space had a broken fence gate that did not properly close or latch to ensure that the area was properly gated.
Three children's files did not have the emergency contact listed for the individual listed by parent on the children's admission form. Additionally, one other children's files did not have a date of admission listed for the child or the required parent signature.
There was only one caregiver present at the start of the inspection and there were 12 children present. The youngest child was 17 months old and therefore, the operation was over ratio as this requires that there only be 11 children present with one caregiver.
The fire extinguisher was mounted more than 5 feet from the ground.
During the 04/19/2021 inspection, child care was being provided to one unrelated child. Child care has been provided at the provider's personal home for unrelated children since 03/2020, 5 days a week, 8am-4pm, which falls under the regulation of a Listed Family Home, and the provider is not listed with Child Care Regulation as a Listed Family Home.
Child care that falls under regulation of a Listed Family Home has been provided at the home of the provider for unrelated children since 03/2020; two 9 month old infants, and a 17 month old child, from 7:45am to 4:00pm, Monday through Friday, that were present during two inspections. The provider was compensated for this child care. The provider is not listed with Child Care Regulation as a Listed Family Home.
